State Sovereignty Reflex on Labour Migration: Transformation of United Kingdom's Points-Based System in the Context of "Brexit"

Abstract

The argument that state sovereignty has been eroded with the globalization process is limited in the context of international migration. Despite the increasing momentum of international migration, states still retain the power to decide who can reside and work in the country under their sovereignty. Again, the globalization process embodied by supranational formations such as the European Union (EU) can encounter reactions that emphasize state authority with the discourse of “national sovereignty”. United Kingdom’s ending its years-long EU membership with the “Brexit” process is the clearest sample of this. The aim of this article, which argues that sovereignty reflex of states’ are still powerful in the context of international migration, is to contribute to the literature by presenting the argument through labour migration policy of the United Kingdom. Within this framework, the article focuses on labour migration and so the transformation of the points-based system implemented in the country within the scope of skilled labour migration policy is examined by comparing the “Pre-Brexit” and “Post-Brexit” periods. At the end of the article, the effective position of the state is revealed by giving place the effects of the changing labour migration policy in the country.

Küreselleşme süreci ile birlikte devlet egemenliğinin aşındığı argümanı uluslararası göç bağlamında sınırlıdır. Uluslararası göçün artan ivmesine rağmen devletler, egemenlikleri altındaki ülkede kimlerin ikamet edebileceğine ve çalışabileceğine karar verme gücünü hala ellerinde bulundurmaktadır. Yine Avrupa Birliği (AB) gibi ulus-üstü oluşumlarla somutlaşan küreselleşme süreci, “ulusal egemenlik” söylemiyle devlet otoritesine vurgu yapan tepkilerle karşılaşabilmektedir. Birleşik Krallık’ın yıllar süren AB üyeliğine “Brexit” süreci ile son vermesi bunun en açık örneğidir. Devletlerin egemenlik reflekslerinin uluslararası göç kapsamında hala güçlü olduğu argümanını savunan bu makalenin amacı, mevcut argümanı Birleşik Krallık’ın emek göçü politikası üzerinden ortaya koyarak literatüre katkı sağlamaktır. Bu çerçevede makalede emek göçü konusuna odaklanılmış ve nitelikli emek göçü politikası kapsamında ülkede uygulanan puanlama sisteminin dönüşümü “Pre-Brexit” ve “Post-Brexit” dönemlerinin karşılaştırılması yöntemiyle ele alınmıştır. Makale sonunda, ülkede değişen emek göçü politikasının etkilerine yer verilerek devletin etkin konumu ortaya konulmuştur.
