The Juridical Controversy on the Sale of the Property with the Foundation (Waqf) in the Reign of Suleyman the Magnificent and under the Shadow of his Viziers: The Mill Case

Abstract

Mevkufatci Muhammed Bey's heritage is bought by the vizier Haydar Pasha around the year of 1550. Mevkufatci's children, however, file a suit against Haydar Pasha, claiming that Mevkufatci's heritage is a foundation (waqf). This case is won by Haydar Pasha in 1551. Mevkufatci's children, however, consult to the mufti, Ebussuud Efendi, about this result. The Grand vizier, Rustem Pasha also talks over this result with Sultan Suleyman the Magnificent. Sultan is an appellant for this case. This time, Mevkufatci's children won it. In this study the experiences during this time known as the mill case is analyzed in terms of the relations of Ottoman scholars with the central government.
