Gazalî ve İbn Rüşd'ün hüküm istinbâtındaki temel paradigmaları

Abstract

Bu makalede İslâm düşünce tarihinde derin izler bırakan, farklı fıkhî geleneklerden gelen ve farklı havzalarda yetişen iki önemli şahsiyetin hüküm istinbâtında izledikleri metodlar ile bu metodların izlenmesinde etkili olan temel tasavvurlar ele alınacaktır. Bu isimlerden birincisi olan Gazalî, hicri V. yüzyıl’da Bağdat’ta yaşamış ve Şafiî ekole mensuptur. İbn Rüşd ise, hicri VI. asırda Endülüs’te yaşamış ve Malikî gelenekten gelmiştir. Zikredilen bu farklılıklarla birlikte her iki isim de belirli bir ekolün sınırları içine hapsedilemeyecek ve geniş bir yelpazede ele alınabilecek fikirler ileri sürmüşlerdir. Görüşlerindeki bu esnekliğin, sahip oldukları bilgi birikimiyle ilgisini kurmak elbette mümkündür. Nitekim her iki müellif de kelam, felsefe, tasavvuf, fıkıh gibi pek çok disiplini bir araya getirmeyi başarmasıyla tanınır, özellikle İslami ilimlerde dil ve mantığa dair görüşleriyle dikkat çekerler. Makalemizde her iki müellifin bu bağlamdaki görüşlerine genişçe yer verilecektir.In this article, we will focus on the methods used by the twoimportant personalities who have left deep traces in the history of Islamic thought and come from different fiqh traditions and are raised in different basins, and the basic ideas that are effective in the follow-up of these methods. Ghazali, the first ofthese names, lived in Baghdad in the late 18th century and belonged to the Shafi'i school. Ibn Rushd, the hijri VI. He lived in Andalusia for centuries and came from Maliki tradition.With these differences mentioned, both names could not be imprisoned within the boundaries of a particular school, and put forward ideas that could be dealt with in a wide range of ways. Of course, it is possible to relate this flexibility in their views to the knowledge they possess. Indeed, both authors are well known for their ability to bring together many disciplines such as kalam, philosophy, mysticism, jurisprudence, and they draw attention with their views on language and logic, especially in Islamic sciences. In our paper, the views of both authors in this context will be given broadly.
