İslâm hukûkunda şûrâ ve istişâre

Abstract

İslâm dîni genel itibariyle insanlar için bir takım prensipler belirlemiştir. Kimi prensiplerin uygulanması açık, kesin ve bağlayıcı hükümlerle belirtilmişken, kiminin uygulanması ise açık, kesin ve bağlayıcı bir hükümle belirtilmemiştir. Şûrâ ve istişâre prensibi de İslâm’ın Hz. Peygamber (S.a.s) nezdinde tüm Müslümanlara bir emir ve tavsiyesidir. Bu emir bizzat Hz. Peygambere (S.a.s) hitap gibi görünmüş olsa da aslen tüm müminlere bir hitap ve tavsiyedir.Çalışmamızın amacı, Allah’ın Kur’ân’da açıkça emretmiş olduğu şûrâ ve istişâre emrinin içeriğini, önemini ve kapsamını her yönüyle ortaya koymaktır. Çalışmamızda öncelikle şûrâ ve istişâre konusuyla ilgili bu zamana kadar yapılan çalışmalar incelenerek, daha önce değinilmemiş veya eksik kalan yönler tespit edilmiş ve bu eksik yönler tamamlanmaya çalışılmıştır. Yine daha önceki çalışmalarda değinilmiş olan konular da genişletilerek farklı bir bakış açısıyla İslâm Hukûku perspektifinden ele alınmıştır. Özetle, çalışmada şûrâ ve istişâre emrine muhâtap olan insanın özellikleri, yeryüzündeki konum ve görevleri, şûrâ ve istişârenin genel olarak anlam ve önemi, İslâm dînindeki yeri, İslâm Hukûkunun kaynakları olan aslî delillerdeki konumu, mezheplerin ictihadi olarak bakış açıları, devlet idaresinde şûrâ ve istişârenin durumu, uygulanma biçimleri ve herhangi bir yaptırımının olup olmadığı vb. hususlara değinilerek, konularla ilgili görüşler sunulmuş, çözüm yollarıyla ilgili öneriler ortaya konulmaya gayret gösterilmiştir.

Islamic religion has determined several principles for people in general. While the practice of certain principles is specified in clear, conclusive and binding provision, the implementation of certain is not specified by a clear conclusive and binding provision. Shura and consultation principle on order and advice to all Muslims in the eyes Prophet (P.b.u.h) of Islamic. Although this order seem as address to the Prophet himself, essentialy it is on address and advice to all believers. The aim of our study is to reveal the content, importance and scope of the shura and consultation order that Allah has clearly stated in the Quran. In our study firstly, analyzed the studies related with shura and consultation, subject conducted until this time, the previously touch up on or missing directions have been determined and these deficiencies have been tried to be completed. It again the subjects mentioned in the previous studies were also expanded, Islam law appraached in the terms of Islam law with a different perspective. Summarize, in the study characteristics of the person who is be interlocutor to order shura and consultation, location and tasks on earth, the meaning and importance of shura and consultation in general, place of religion in Islam the position substansive and in kind right of the sources of Islamic law, perspectives of sects as jurisprudence (ijtihad), status of shura and consultation state administration, forms of application and whether or not is a whatever sonction etc. refering to considerations, opinions issues related, effort has been put forward suggestions for solutions.
